Illegal Early Access Is a Serious Breach
We caution that accessing your super benefits before meeting a condition of release is a serious breach. The
breach will be reported to the ATO by the SMSF auditor.
The withdrawals will be included in your assessable income and be taxed in your personal tax return, without
any tax offsets.
Moreover, the ATO may impose other penalties (e.g. disqualify you as the SMSF Trustee, make your SMSF
non-complying). In the most extreme case, individual Trustees may face penalties of up to $420,000 ($1.1
million for Corporate Trustees) and jail terms of up to five years.
